Terms and Conditions

By using Pegasus Productions' services, you acknowledge that you have read, understood, and agree to these terms and conditions.
1. Acceptance of Terms By using Pegasus Productions' services, you agree to comply with and be bound by these terms and conditions.
2. Services
2.1 Design
Clients engaging Pegasus Productions for design services acknowledge that any changes to the design after the original invoice has been paid will incur additional costs and fees. It is the client's responsibility to communicate design modifications promptly.
2.2 Construction
Clients engaging Pegasus Productions for construction services acknowledge that any changes to the construction of the project after construction has commenced will incur additional costs and fees. It is the client's responsibility to communicate construction modifications promptly.
2.3 Delivery
Clients engaging Pegasus Productions for delivery services acknowledge that any bump-in or delivery of a product not originally planned during the design and consultation stage may incur a higher cost than standard bump-in rates due to the last-minute nature of the request. Clients are advised to communicate additional delivery requirements as early as possible.
3. Payment
3.1 Due Date: Payments must be made by the specified payment date outlined in our billing policy, and work will not commence until payment is received.
3.2 Invoicing: Invoices will be issued according to the agreed-upon billing schedule.
3.3 Final Payment: The final payment for services rendered is due within 7 days from the date of the final invoice.
3.4 Late Payments: A late fee will be incurred if the final payment is not received within 7 days of the final invoice date. Failure to make timely payments may result in the suspension of services until outstanding payments are received.
Clients are responsible for ensuring that payments are made promptly to avoid late fees and any disruption in service.
4. Confidentiality Both parties agree to keep confidential information exchanged during the course of the engagement.
5. Intellectual Property All designs, concepts, renders, or construction plans created by Pegasus Productions during the course of providing services are the exclusive property of Pegasus Productions. Clients are granted a non-exclusive license to use these intellectual property assets solely for the intended purpose outlined in the agreement. Unauthorized use, reproduction, or distribution of these assets is strictly prohibited without the express written consent of Pegasus Productions.
6. Termination Either party may terminate the agreement with written notice. Termination fees may apply as specified in the agreement. Pegasus Productions reserves the right to keep any money already paid by the client to cover losses incurred due to the termination of a project or event. Such retained funds will be used to offset any costs, expenses, or damages suffered by Pegasus Productions as a result of the termination.
7. Liability
7.1 Limitation of Pegasus Productions' Liability: Pegasus Productions shall not be liable for any direct, indirect, incidental, or consequential damages arising from the use of our services.
7.2 Client Responsibility: Once goods are handed over to the client, the client assumes full responsibility for any damage, loss, or injury resulting from the use or handling of the delivered goods.
8. Governing Law This agreement is governed by the laws of South Australia. Any disputes will be resolved through arbitration or in a court of competent jurisdiction within South Australia.
9. Modification of Terms Pegasus Productions reserves the right to update these terms and conditions. Clients will be notified of any changes, and continued use implies acceptance.
10. Miscellaneous Any waivers or amendments must be in writing. If any provision is found invalid, the remaining provisions will continue in full force.
